Information on private sales
At a glance: Devices marked “Private sale” are sold by a private individual – we act as intermediary. Your contract is with the seller, not with CompuMac. There is no right of withdrawal, and the statutory warranty is excluded except for the statutory exceptions. 1. What is a private sale?
Devices marked “Private sale” belong to private individuals. We act as an intermediary: we check and describe the device, offer it in our online shop and in our store, take reservations and hand over the device in our store on the seller’s behalf. We conclude the purchase contract in the name and for the account of the seller. The device belongs to the seller until it is sold; we do not buy it.
2. Who your contract is with
Your contract is with the seller, not with CompuMac. The seller has declared to us that they are selling the device as a private individual and not as a business. We don’t name the seller in the shop. We’ll give you the seller’s name and town with the reservation confirmation. We’ll give you their full address if you need it to assert claims under the purchase contract.
3. No consumer protection rules, no right of withdrawal
Because, according to their declaration, the seller is not a business, the special rules for consumer contracts do not apply to the purchase contract. In particular, you have no statutory right of withdrawal, and the rules on consumer goods sales – for example on the minimum statutory warranty period and on the presumption that a defect already existed at handover – do not apply.
4. Statutory warranty
The seller’s statutory warranty (liability for defects) is excluded. This does not apply to the condition stated in the item description, to defects that were fraudulently concealed, or where the seller has given a guarantee. Claims for damages for injury to life, body or health and for intentional or grossly negligent breach of duty also remain unaffected. These claims are against the seller.
If the device is still covered by a manufacturer’s warranty, we’ll state this in the description, as far as we know of it. It applies under the manufacturer’s terms.
5. Our role
The seller uses us to fulfill the purchase contract: we reserve the device for you, accept the purchase price in our store as the seller’s agent in the seller’s name, hand the device over to you there, and receive questions and complaints. Once you’ve paid us, the purchase price is deemed paid to the seller. The seller pays us a commission for our service; you don’t pay anything extra for it.
This support does not give you any contractual claims of your own against us under the purchase contract. We are liable for our own breaches of duty in accordance with the statutory provisions and § 30 of our terms and conditions. The details are set out in § 12b of the terms and conditions.
6. Reservation, price, payment and handover in our store
Reserve instead of cart: A private sale can’t be added to the cart or paid for online. On the device’s page you can reserve it with “Reserve” (name, email, phone). You’ll get an email with a confirmation link; only once you’ve confirmed is the device reserved for you. We then hold it for you – the reservation confirmation states for how long, usually 3 days. The reservation is free and doesn’t yet oblige you to buy. If you don’t come within this period, the reservation ends and the device is available again.
Payment and handover in our store only: Payment and handover take place exclusively in our store, Werastraße 42, 88045 Friedrichshafen – in cash on collection. We accept the money as the seller’s agent in the seller’s name. Bank transfer, card, PayPal, Klarna and other payment methods are not available for private sales, and we don’t ship private sales. Please never transfer money for a device from a private sale – even if someone asks you to; if in doubt, call us.
Purchase contract: The purchase contract is concluded in our store when you pay the purchase price and take the device. Risk passes to you on handover.
Price: The price shown is the final price. No VAT is charged on private sales, so there is no net price.
7. Order of listings
In overviews, you can choose the order yourself, for example by price. If you don’t choose, we show the most recently listed devices first; the listing date is then the only criterion. When you search, our shop’s search function sorts by relevance – mainly by how well the product name and description match your search term.
We don’t take money for better placement. We rank our own devices and private sales by the same rules.
8. Questions and complaints

9. Want to sell a device yourself? How it works
- Bring the device to our store. Please bring your ID, turn off “Find My” and back up your data. We only sign the brokerage agreement in our store in Friedrichshafen.
- We check the device, measure the battery and describe its condition, signs of use and what’s included. You read the description and confirm with your signature that it’s accurate to the best of your knowledge.
- You set the selling price. We won’t sell below it. Any change is agreed with you in text form, for example by email.
- You sign the brokerage agreement and get a copy. It states the device, price, commission, payout, your bank details for the payout and the term. § 12c of our terms and conditions also applies.
- We offer the device as a “Private sale” – in the online shop for reservation and in the store. Your name doesn’t appear anywhere.
- When someone buys your device, they pay at our store and we hand it over to them there. We let you know and settle up with you (section 10).
If you’d rather sell your device directly to us, that isn’t a private sale but a purchase by CompuMac. We’ll be happy to make you a separate offer for it. The two can’t be combined: for a device we broker, we pay no advance, guarantee no minimum price and don’t credit anything towards a purchase from us.
10. Commission and payout
Commission: Only if your device sells, we receive a commission of 8% of the selling price including VAT, but at least €30 including VAT. There are no other costs for you. If the device doesn’t sell, our service is free of charge for you. The amount in your brokerage agreement is what counts.
Examples: selling price €600 – commission €48 – payout to you €552. Selling price €300 – 8% would be €24, so the minimum commission of €30 applies – payout to you €270.
Payout: The buyer pays at our store; we accept the purchase price as your agent in your name. 14 days after the buyer has received the device, we transfer the purchase price minus the commission to the account in your brokerage agreement. Until then, we hold the purchase price for you. We invoice the commission to you with VAT shown. If the buyer asserts claims under the purchase contract before the payout, we’ll inform you and only pay out the amount concerned once the matter is settled.
Reversal: If the purchase contract is reversed, our commission lapses and you get your device back. We refund any commission already retained. The buyer gets the purchase price back – from the amount we still hold for you, or from you if we have already paid it out to you.
End of the agreement: The agreement runs until the date agreed in the brokerage agreement. You and we can end it at any time in text form; a purchase contract already concluded is not affected. You then collect your device from our store within 14 days – we’ll remind you.
11. Your details and your responsibility as a seller
Your name stays with us until a buyer has reserved the device. We then give the buyer your name and town with the reservation confirmation (if they buy in our store without a reservation, before the purchase). The buyer only gets your full address if they need it to assert claims under the purchase contract. Your bank details are only on the signed brokerage agreement; we need them for the payout and never pass them on.
You are the seller. The purchase contract is between you and the buyer, on the terms in § 12b of our terms and conditions: no right of withdrawal and exclusion of the statutory warranty – except for the condition described, for defects fraudulently concealed, for a guarantee you have given, and for damages for injury to life, body or health and for intentional or grossly negligent breach of duty. You are liable to the buyer for these claims. So please tell us everything you know about defects of the device.
Taxes: Where we are required to do so under the German Platform Tax Transparency Act (PStTG), we collect the details it prescribes, such as your tax identification number and date of birth, and report details of your sales to the Federal Central Tax Office. You are responsible for paying tax on any profit yourself. Our privacy policy (section 11a) explains how we process your data.
